AGREEMENT
Introduction:
The following
constitutes an agreement (the "Agreement") between Jock
Doubleday (the "Coordinator") and [
]
(the "Participant").
PART A
General Terms:
Participant agrees to
abide by the general terms outlined in the offer (Appendix A) created by
Coordinator August 1, 2006 (the "Offer"). Specifically,
Participant agrees to publicly drink a body weight-calibrated mixture (the
"Mixture") of standard vaccine additive ingredients (the "Ingredients") in the same
amount as a six-year-old child is recommended to receive under the year-2005
guidelines of the U.S. Centers for Disease Control and Prevention. In exchange
for Participant's public ingestion of the Mixture (the "Event"), Coordinator agrees
to pay Participant $75,000.00 (seventy-five thousand U.S. dollars) (the "Reward").
A. Definition of
Terms
1. "publicly"
means in a public forum, the place and time of which are to be determined by
Coordinator;
2. "body
weight-calibrated" means increased in dosage by the same factor as
Participant's body weight is greater than the body weight of an average
American child at the beginning of her third year;
3. "standard
vaccine additive ingredients" means ingredients and additive ingredients,
other than the active agent(s), standardly present in vaccines, including, but
not necessarily limited to, sodium ethylmercurithiosalicylate (or thimerosal, a mercury
derivative), phenoxyethanol (antifreeze), phenol (a disinfectant dye), phenol
red, formaldehyde (a preservative and
disinfectant), ammonium sulfate, aluminum hydroxide, aluminum phosphate, benzethonium
chloride,
polysorbate 20, polysorbate 80, sorbitol, polyribosylribitol, MRC5 proteins, betapropiolactone, neomycin, neomycin sulfate, streptomycin, polymyxin, polymyxin B, amphotericin B,
gentamicin sulfate, tri(n)butylphosphate, freeze-dried polysaccharide antigens (from Neisseria
meningitidis), monosodium glutamate, potassium monophosphate, potassium
diphosphate, human serum albumin, washed sheep red blood cells, porcine (pig)
pancreatic hydrolysate of casein, embryonic fluid (chicken egg), hydrolyzed
gelatin
(calf and cattle skins, cattle bones and pork skin), calf serum, fetal bovine serum, fetal rhesus
diploid cells (FRhL-2 cell line), African green monkey kidney heteroploid
cells (Vero
cell line), and human diploid cells (human aborted fetal tissue), in the forms and
proportions standard in the vaccines in question;
4. "standard"
means used in one or more of the vaccines recommended by the U.S. Centers for
Disease Control and Prevention in the time period in question;
5. "six-year-old
child" means a child at the end of her sixth year.
Requirements for
Participant Eligibility:
To be eligible for and
to secure Participant's participation in the Event, Participant agrees to the
following terms:
A. Psychiatric
Evaluations
Participant agrees to
undergo psychiatric evaluations (the "Evaluations") for signs of
clinical depression, manic depression, and/or suicidal tendencies, said
Evaluations to be made consecutively by three psychiatrists (the "Therapists") to be named by
Coordinator and paid for by Participant, within 60 (sixty) days of
Participant's signing of the Agreement. If, in any of the Evaluations,
Participant is found to be clinically depressed, manic depressive, suicidal, or
in any way psychologically unstable and/or of unsound mind, Participant becomes
ineligible to participate in the Event and forfeits any claim to the Reward.
Evaluations will not be sent to, or seen by, Participant but will be sent
directly by Therapists to Coordinator, within 30 (thirty) days of the
completion of the Evaluations, by certified mail, to a postal address to be
named. Evaluations will be reviewed only by Coordinator and/or his legal
representative(s). Evaluations will not be duplicated, distributed, or
publicized in any media, in perpetuity, by Coordinator or his legal
representative(s) or any agent of the aforesaid.
B. Mental Health
Records
Participant agrees to
submit, within 45 (forty-five) days of Participant's signing of the Agreement,
documents comprising a verifiable written history of all psychological
counseling and therapy (the "Mental Health Records"). Mental Health
Records will be sent by certified mail to Coordinator at a postal address to be
named. Mental Health Records will be reviewed only by Coordinator and his legal
representative(s) and will not be duplicated, distributed, or publicized in any
media, in perpetuity, by Coordinator or his legal representative(s) or any
agent of the aforesaid. If it is discovered that any part of Mental Health
Records has been withheld by Participant, Participant becomes ineligible to
participate in the Event and forfeits any claim to the Reward. If the Reward,
or any portion of the Reward, has already been paid to Participant upon the
discovery by Coordinator of withholding of any part of Mental Health Records,
Participant agrees to remit to Coordinator, within 30 (thirty) days of notice to remit, both the portion paid and
a monetary amount to be named covering all costs of Coordinator's planning and
producing of the Event, said amount to include an hourly rate of $75/hour for
the creation of a) the Agreement and b) all correspondence with Participant.
C. Email Examination
Participant agrees to take
a written open-book examination (the "Basic Exam") before becoming
eligible to receive Part B of the Agreement. The Basic Exam will be sent by
Coordinator to Participant by email within 30 (thirty) days of Participant's
email acknowledgement of receipt of Part A of the Agreement, as well as
Participant's signing of Part A of the Agreement and faxing of signed Part A of
the Agreement to Coordinator. The Basic Exam will consist of 10 questions
regarding basic vaccination theory and practice. Participant agrees to email
Basic Exam answers to Coordinator within 10 (ten) days of receiving the Basic Exam. Participant agrees
that a score of less than 100% (i.e., 10 correct answers) on the Basic Exam
constitutes a failure on the part of the Participant in the taking of the Basic
Exam, said failure making Participant ineligible to a) receive Part B of the
Agreement and b) participate in the Event, and obliging Participant to forfeit
any claim to the Reward, should such claim be made, in perpetuity. Participant
agrees that the Basic Exam, and all questions contained therein, and
Participant's answers to the questions contained therein, are the property of
Coordinator and that all rights to the Basic Exam, and all rights to the
questions contained therein, and all rights to Participant's answers to the
questions contained therein, are held fully and exclusively by Coordinator.
Participant agrees to allow duplication, distribution, publication, and/or
discussion, in any media, in perpetuity, of the Basic Exam and any and all
questions or answers contained therein, including Participant's name and email
contact information. Participant agrees that no action will be brought by
Participant or agent of Participant against Coordinator or his affiliates, in
perpetuity, for the duplication, distribution, publication, and/or discussion,
in any media, of the Basic Exam and any and all questions or answers contained
therein, including Participant's name, biographical information, and email
contact information.
D. Book Purchase
To assure Participant's
complete and thorough familiarity with and understanding of possible immediate
and long-term physical and psychological hazards of chemicals commonly used as
disinfectant, preservative, medium, or other additives in vaccines, as well as
possible immediate and long-term behavioral changes that may occur from
ingestion of or contact with these chemicals, Participant agrees to obtain at
Participant's cost the following recently published books (the "Books"):
1) Vaccines:
Are They Really Safe and Effective? by Neil Z. Miller;
2) Immunization:
The Reality Behind the Myth, by Walene James;
3) Vaccination,
Social Violence and Criminality: The Medical Assault on the American Brain, by Harris L. Coulter;
4) The
Sanctity of Human Blood: Vaccination Is Not Immunization, by Tim O'Shea;
5) What Every
Parent Should Know About Childhood Immunization, by Jamie Murphy.
E. Written
Examination
Participant agrees to
take a written closed-book examination (the "Exam") administered by
Coordinator or his agent within 60 (sixty) days of the signing of the
Agreement-in-full. The Exam will be administered at a location within a
100-mile radius of Participant's business office, said location to be chosen by
Coordinator or his agent. The Exam will consist of five separate closed-book
exams of 20 yes/no, true/false, multiple-choice, and/or short-answer questions
from each of the five Books listed above. Participant agrees that a score of
less than 90% (i.e., 18 correct answers out of 20 possible correct answers) on
any of the five separate exams will constitute a failure on the part of the
Participant in the taking of the Exam, said failure making Participant
ineligible to participate in the Event and obliging Participant to forfeit any
claim to the Reward. Participant agrees that the Exam will have as its maximum
time limit two hours and that Coordinator or his agent will be the sole
administrator of the Exam and that only Participant and Coordinator or
Coordinator's agent will be allowed into the testing area. Participant agrees
that the Exam, and Participant's answers to the questions contained therein,
are the property of Coordinator and that all rights to the Exam and all rights
to Participant's answers to the questions contained therein, and all rights to
the duplication, distribution, and publication in any media of the Exam, in
perpetuity, and all questions contained therein are held exclusively by
Coordinator.
F. Good Health
Certification
To certify that
Participant is in normal health ("Good Health") (so that, upon
Participant's possible sickness or death after the ingestion of the Mixture,
Participant and/or agents of Participant cannot reasonably claim that sickness
or death was due to causes other than the ingestion of the Mixture),
Participant agrees to a general physical exam including a blood test (the
"Physical Exam"), at Participant's expense, given by a medical
professional (the "Practitioner") to be named by Coordinator, within 75
(seventy-five) days of Participant's signing of the Agreement. If Practitioner
is not able to certify Participant to be in Good Health, Participant becomes
ineligible to participate in the Event and forfeits any claim to the Reward, in
perpetuity. Participant may review Practitioner's records (the "Physical
Health Records") of the Physical Exam. Participant agrees to send, or to
have Practitioner send, Physical Health Records by certified mail to
Coordinator, at a postal address to be named, within 10 (ten) days of the
Physical Exam. Participant agrees that, as part of the Physical Exam,
Practitioner will measure the body weight of Participant, such figure to be
used in calibrating the dosage of the Mixture. Participant's body weight will
also be measured on the day of the Event. If on the day of the Event
Participant's body weight is more than five pounds greater than the figure
given by Practitioner, Participant becomes ineligible to participate in the
Event and forfeits any claim to the Reward.
Securing of Medical
Professionals:
Participant agrees to
secure three medical professionals (the "Participant's Professionals") within 90
(ninety) days of signing the Agreement, for the purpose of creating and/or
supervising the creation of the Mixture, with equal creative input and
supervision to be provided by three medical professionals chosen by Coordinator
(the "Coordinator's Professionals"). If Participant is unable to
locate and secure Participant's Professionals within 90 (ninety) days of
signing the Agreement, Participant becomes ineligible to participate in the
Event and forfeits any claim to the Reward.
Risk Information:
Participant agrees to
send to Coordinator by certified mail within 30 (thirty) days of the signing of
the Agreement hard copies of all risk/benefit materials routinely given by Participant
to patients, or parents or guardians of patients, receiving vaccinations from
Participant.
Television
Appearances:
Participant agrees to
make at least five regional or national television appearances (the "Appearances") with
Coordinator, or as many as Coordinator requests up to and including five
appearances. Participant agrees that travel, lodging, food, and any and all
other costs associated with Appearances will be at Participant's expense.
Web Site Postings:
Before signing Part A
of the Agreement, Participant agrees to email to Coordinator a recent jpeg
headshot of Participant, to be posted, in perpetuity, with Participant
biographical information of Coordinator's choosing, and Participant email
contact information, and any and all correspondence between Participant and
Coordinator and any and all correspondence between Participant's agent and
Coordinator and/or Coordinator's agent, and any and all correspondence between
Participant and Coordinator's agent, on a web site or web sites of Coordinator's
choosing.
Participant Email
Address and Sendings:
Participant agrees to
maintain a working email address at Participant's primary office, where public
queries regarding the Offer, the Agreement, and/or the Event can be sent.
Participant agrees to make personal (non-form letter) responses to any and all
email queries regarding the Offer, the Agreement, and/or the Event for a period
of 5 (five) years after the date of the Event.
Participant
Donations:
In the event that
Participant signs Part A of the Agreement but fails to sign the
Agreement-in-Full within 120 (one hundred and twenty) days of the signing of
Part A of the Agreement, Participant agrees to donate by check the amount of
$5,000.00 (five thousand U.S. dollars), or by PayPal the amount of $5,150.00
(five thousand one hundred and fifty U.S. dollars), to the California 501(c)3
nonprofit corporation Natural Woman, Natural Man, Inc., or in the case of said
corporation's dissolution, to a nonprofit organization to be named by
Coordinator, or Coordinator's agent, said donation to be made within 180 (one
hundred and eighty) days of Participant's signing of Part A of the Agreement.
In the event that
Participant signs the Agreement-in-Full but fails to participate in the Event
by publicly drinking the Mixture, Participant agrees to donate by check the
amount of $10,000.00 (ten thousand U.S. dollars), or by PayPal the amount of
$10,300.00 (ten thousand three hundred U.S. dollars), to the California 501(c)3
nonprofit corporation Natural Woman, Natural Man, Inc., or in the case of said
corporation's dissolution, to a nonprofit organization to be named by
Coordinator, or Coordinator's agent, said donation to be made within 180 (one
hundred and eighty) days of Participant's signing of the Agreement-in-Full.
Indemnification:
Participant agrees to
indemnify and hold harmless, in perpetuity, any and all persons, organizations,
and entities associated with the Offer, the Agreement, or the Event for any
harm caused, or alleged to be caused, directly or indirectly, to Participant or
indirectly to Participant's heirs, relations, employers, employees, colleagues,
associates, or other persons, organizations, or entities claiming association
with, or representation of, Participant, by Participant's participation in the
Event. Specifically, Participant agrees to indemnify and hold harmless
Coordinator, his relations, employers, employees, colleagues, agents,
associates, and any and all other persons, organizations, and entities
associated with Coordinator and/or Natural Woman, Natural Man, Inc., its
affiliates, officers, employees and agents, and any and all persons,
organizations, and entities associated with Natural Woman, Natural Man, Inc.,
from any claim, demand, or damage caused by, or arising out of, events
associated with the Offer, the Agreement, and the Event, and specifically from
events associated with medical testing, written examinations, media
appearances, web site postings of Participant's biographical information and/or
photo(s), and any and all other Participant and/or Coordinator activities
detailed in the Agreement and/or performed by Participant and/or Coordinator.
Limitation of
Liability:
Neither Coordinator nor
his relations, employers, employees, colleagues, agents, associates, or other persons,
organizations, or entities associated with Coordinator, nor Natural Woman,
Natural Man, Inc., its affiliates, officers, employees, agents, or any persons,
organizations, or entities associated with Natural Woman, Natural Man, Inc.,
shall be held liable by Participant or Participant's agent for any indirect,
incidental, special, or consequential damages arising out of, or in connection
with, the Offer, the Agreement, or the Event, in perpetuity.
